Terms of Service — Trakko Footwear

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "User," or "Customer") and Trakko Footwear LLC, a limited liability company registered in the State of Florida, United States ("Trakko Footwear," "we," "us," or "our"), governing your access to and use of trakkofootwear.com and any related services (collectively, the "Site").
By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or place an order on the Site. By using the Site, you represent and warrant that you meet this requirement. If you are placing an order on behalf of a minor, you accept full responsibility for that order.
2. Geographic Scope
Trakko Footwear currently ships to Europe, North America, and select other regions, as indicated at checkout. We do not currently ship to, sell to, or accept orders from South America. Orders placed with a shipping or billing address in South America may be canceled and refunded at our discretion.
3. Account Registration
To access certain features (such as order tracking or saved addresses), you may need to create an account. You agree to:
- Provide accurate, current, and complete information;
- Keep your login credentials confidential;
- Notify us immediately at sac@trakkobrazil.com of any unauthorized use of your account.
We are not liable for any loss arising from your failure to safeguard your account credentials.
4. Products, Pricing, and Availability
- All product descriptions, images, and prices are subject to change without notice.
- Prices are displayed in the currency selected at checkout and may not include applicable customs duties, import taxes, or fees for international orders, which are the responsibility of the customer unless otherwise stated.
- We make reasonable efforts to display accurate product information, but we do not warrant that product descriptions, pricing, or other content is error-free. In the event of a pricing or listing error, we reserve the right to cancel any order placed based on the incorrect information, and to issue a full refund.
- Product availability is not guaranteed until an order is confirmed. Limited-edition or high-demand items may sell out or be subject to release/raffle mechanics, which will be governed by specific rules communicated at the time of the release.
5. Order Acceptance
Your order is an offer to purchase, not an acceptance by us. We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to: suspected fraud, unauthorized or illegal activity, pricing errors, stock unavailability, or violation of these Terms. If we cancel a confirmed order, we will notify you and issue a refund for any amount already charged.
6. Payment
- Payment is processed securely through our third-party payment providers at the time of order confirmation.
- By providing payment information, you represent that you are authorized to use the selected payment method.
- We reserve the right to request additional identity or payment verification for orders flagged as high-risk, and to hold or cancel such orders pending verification.
7. Shipping and Risk of Loss
Shipping terms, timelines, and costs are detailed in our separate Shipping Policy. Risk of loss and title for products pass to you upon our delivery to the shipping carrier, except where mandatory consumer protection law in your country of residence provides otherwise (e.g., for EU consumers, risk passes upon delivery to the consumer).
8. Returns and Refunds
Returns and refunds are governed by our separate Return and Refund Policy, incorporated into these Terms by reference.
9. Product Authenticity
Trakko Footwear only sells products sourced through authorized channels. We do not knowingly sell counterfeit goods. If you have reason to believe a product received from us is not authentic, please contact sac@trakkobrazil.com immediately so we can investigate.
10. Intellectual Property
All content on the Site — including but not limited to text, graphics, logos, product photography, layout, and underlying code — is the property of Trakko Footwear or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent. Unauthorized use may result in legal action.
11. Acceptable Use
When using the Site, you agree not to:
- Violate any applicable law or regulation;
- Use automated tools (bots, scrapers, scripts) to access the Site, place orders, or extract data without our express written permission;
- Attempt to gain unauthorized access to any part of the Site, other accounts, or our systems;
- Interfere with or disrupt the security, integrity, or performance of the Site;
- Use the Site for any fraudulent, unlawful, or unauthorized purpose, including but not limited to abusing promotional offers, raffles, or discount codes.
We reserve the right to suspend or terminate your account and cancel any associated orders if we reasonably believe you have violated this Section.
12. Disclaimer of Warranties
The Site and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, except as required by applicable law (including statutory consumer guarantees available to EU consumers, which are not waived by this Section). We do not warrant that the Site will be uninterrupted, secure, or error-free.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Trakko Footwear LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Site or purchase of products, even if advised of the possibility of such damages.
Our total aggregate liability for any claim arising from these Terms or your purchase shall not exceed the total amount paid by you for the specific order giving rise to the claim.
Nothing in this Section limits any liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights available to EU residents.
14. Indemnification
You agree to indemnify and hold harmless Trakko Footwear LLC and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where mandatory consumer protection law of your country of residence provides otherwise.
Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida, United States, unless mandatory law in your jurisdiction (e.g., for EU consumers) grants you the right to bring proceedings in the courts of your own country of residence, in which case that right is preserved.
EU consumers may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/ for the out-of-court resolution of consumer disputes.
16. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms. Material changes will be communicated via email or a notice on the Site where required by law.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
